Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SimpliKraft AI mobile app, website, APIs, templates, generation workflows, saved designs, and related services ("Service"). By using the Service, you agree to these Terms and our Privacy Policy.

1. What SimpliKraft AI Does

SimpliKraft AI helps users create AI-assisted images from templates, user-entered text, and optional user-uploaded reference photos. Some templates require a photo, while prompt-based or no-photo workflows may not. Generated results may vary and are not guaranteed to be accurate, realistic, unique, legal for every use, or suitable for professional reliance.

2. Accounts and Security

• You must provide accurate account information and keep your sign-in credentials secure.
• You are responsible for activity performed through your account.
• You may not create multiple accounts, use automation, bypass quotas, attack the Service, scrape private APIs, or interfere with app security.
• You can delete your account from the app Profile screen or through our Data Deletion page.

3. User Content and Responsibility

"User Content" includes photos, prompts, text fields, templates you configure, uploaded assets, generated images, saved designs, and anything else you submit or create through the Service. You retain your rights in your User Content, subject to the limited license below.

You are solely responsible for the legality, rights, permissions, and consequences of your User Content and your use or sharing of generated outputs. Do not upload or generate content unless you have the required rights and consent.

4. Limited License to Operate the Service

You grant SimpliKraft AI a limited, worldwide, non-exclusive, royalty-free license to host, transmit, cache, process, display, and store User Content only as needed to operate the Service, provide generation results, maintain saved designs, enforce safety rules, and comply with law. Uploaded input photos for photo-required generation are used only for the selected generation request and are deleted from temporary processing storage after completion or failure.

5. Acceptable Use

You may not use the Service to create, upload, request, store, or distribute content that:

• Is illegal, exploitative, abusive, harassing, hateful, extremist, violent, self-harm promoting, or sexually explicit.
• Sexualizes, exploits, endangers, identifies, or harms minors.
• Impersonates a real person, creates deceptive deepfakes, or misleads people about identity, consent, origin, or authenticity.
• Infringes copyrights, trademarks, publicity rights, privacy rights, or other rights.
• Includes private, confidential, biometric, medical, financial, or government-identification data without lawful authority.
• Promotes scams, malware, spam, unlawful surveillance, weapons misuse, or attempts to bypass platform policies.
• Attempts to reverse engineer, overload, probe, resell, or abuse our generation systems, quotas, APIs, or security controls.

6. AI-Generated Content and Reporting

AI outputs can be imperfect or unexpected. You must review generated results before using or sharing them. If you publish generated content, you are responsible for complying with applicable disclosure, advertising, election, privacy, intellectual property, and consumer-protection rules. You can report unsafe, illegal, infringing, or policy-violating generated content from the app's reveal screen or by emailing support@simplikraft.ai with enough detail for review.

7. Enforcement

We may reject prompts, block generations, remove content, limit features, suspend or terminate accounts, preserve evidence, report activity, or cooperate with lawful requests when content or behavior appears to violate these Terms, platform policy, or law. We may also remove generated assets that are illegal, unsafe, infringing, or abusive.

8. Plans, Ads, Billing, and Refunds

• Free plan: Free usage may include ads, daily or monthly generation limits, rewarded ad requirements, reduced priority, and feature restrictions.
• Paid plans: Paid plans may unlock higher limits, fewer ads, priority processing, or premium features. Plan names, limits, and prices may change.
• Google Play billing: Android subscriptions and in-app purchases are billed by Google Play. Manage cancellation, renewal, payment methods, and refunds through Google Play unless the app states otherwise.
• Failed generations: We aim not to count failed generations against your generation quota. If you believe a quota was charged incorrectly, contact support.
• No resale: You may not resell, rent, automate, or commercially redistribute access to the Service without written permission.

9. Service Operations

The Service depends on cloud hosting, authentication, push notifications, advertising, payment validation, storage, and secure generation processing services. We may update operational vendors, queues, security controls, and processing systems over time to improve reliability, safety, and performance.

10. Intellectual Property

SimpliKraft AI, our branding, interface, templates, curated collections, code, service design, and original assets are owned by us or our licensors. You may not copy, sell, modify, reverse engineer, or use our branding except as allowed by law or written permission. Your generated output rights may depend on your input rights, third-party rights, applicable law, and the policies of underlying services.

11. Account and Data Deletion

Deleting your account removes your SimpliKraft profile, generation records, saved designs, notification tokens, app subscription records stored by us, and app-stored generated assets associated with your account. Google Play billing records and legally required records may remain outside our systems or be retained as required by law. See Data Deletion.

12. Disclaimers

The Service is provided "as is" and "as available." We do not guarantee uninterrupted availability, specific output quality, accuracy, face similarity, originality, legal suitability, commercial fitness, or that generated results will be accepted by any platform or third party.

13. Limitation of Liability

To the maximum extent permitted by law, SimpliKraft AI and its developers, operators, affiliates, and service providers are not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages arising from your use of the Service, generated outputs, uploaded content, account actions, or third-party services. Nothing in these Terms limits liability that cannot legally be limited.

14. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, create risk, abuse the Service, fail payment validation, or if continued operation becomes impractical or unlawful.

15. Governing Law

These Terms are governed by the laws of Maharashtra, India, without regard to conflict-of-law principles, unless mandatory consumer law in your location requires otherwise.
